HORN, Judge.

This Opinion confirms in writing a decision previously issued orally by the court. On the eve of trial, the defendant filed a Motion to Dismiss, requesting the court to dismiss plaintiff’s complaint pursuant to Rule 12(b)(1) of the Rules of the United States Claims Court (RUSCC), for lack of subject matter jurisdiction.
