This is an action brought by tbe plaintiffs, respondents herein, against tbe defendants, appellants herein, on a promissory note purporting to have been executed by tbe defendants on April 22, 1929, made to John W. Hartney for tbe principal sum of $1776.00, due on or before five years after date with interest at tbe rate of 1% per annum payable semi-annually, and providing that in case of suit upon tbe note tbe makers thereof should pay 10% additional as attorney fees.
