Appeal from a judgment of the Superior Court of Los Angeles County, and from an order denying a new trial. The facts are stated in the opinion of the court.

1Opinion of the CourtHarrison, J.

— This is an action for the foreclosure of a mortgage upon real property, executed by the defendants to the plaintiff. The note to secure which the mortgage was given is as follows: —

“ $2,500. Santa Ana, Cal., Oct. 29,1887. .
“ Three years after date, for value received, we promise to pay R. E. Hewitt, or order, at the Commercial Bank *7of Santa Ana, the sum of twenty-five hundred dollars, with interest at the rate of 12-¡- per cent per annum from date until paid; interest payable annually, and if not so paid, to be compounded annually and bear the same rate of interest as the principal; and…
