On motion of appellee, an appeal on questions of law and fact was dismissed on tlae ground that the primary relief sought, as disclosed by the allegations of the petition and cross-petition, is at law. The appeal is retained for determination on questions of law. Plaintiff and cross-petitioners bring this action against the defendants for a declaratory judgment with respect to the provisions of Section 1427 General Code (Section 1533.45, Revised Code).

Section 1427, General Code, provides:

“No person shall draw, set, place, locate or maintain any net whatever on any of the reefs of the Lake…
