This is an action on the case, brought by appellee against appellant in the Circuit Court of Jackson county, to recover-damages under the statute for the death of plaintiff’s intestate, William E. Ring, alleged to have been caused by the negligence and wilfulness of the defendant’s servants. A trial resulted in a verdict and judgment for the plaintiff’ for $5,000, from which the defendant appealed to this court. William E. Ring, the deceased, was killed in a rear-end collision of freight trains on defendant’s road at Belle-ville, in the morning of January 12, 1901. At the time of his death…
