Appeal from special term, Erie county. Injunction by Charles E. Hequembourg against the city of Dunkirk and others. Plaintiff appeals from order denying motion to continue the injunction.

This action was brought to enjoin the municipal authorities of the city of Dunkirk from constructing an electric light plant, and the issuing of the bonds of the city to pay therefor, pursuant to chapter 29 of the Laws of 1888. The act is entitled “An act to authorize the establishment of a system for lighting the city of Dunkirk with electric light, and to empower the common council of said corporation to raise the necessary funds for that purpose.” The first section of the act authorizes the common council of the city to raise a sum, not exceeding $10,000, for defraying the costs and…
