This is an appeal from judgment in favor of defendants in an action, under sections 3439 and 3442 of the Civil Code, to subject certain real property to the payment of a judgment obtained by appellant against defendant George G. Prentice.

In 1916 said defendant opened a general brokerage office in San Diego under the name of “George G. Prentice & Co.,” his son Gordon Prentice being associated with him, and through a connection with the brokerage house of Logan & Bryan he bought and sold stocks and bonds on the leading exchanges of the country.
