On the night of December 24, 1944, plaintiff was injured when the automobile then being driven by him stalled at the intersection of Coleridge Street and Cortland Avenue in San Francisco on the streetcar tracks of defendant city and was hit by a municipal streetcar. Plaintiff brought this action for his injuries and damage to his automobile, alleging that the accident occurred as the result of the negligence of the city.
