This cause is to review the action of the State Industrial Commission refusing the petitioner an award under the Workmen’s Compensation Act of the state of Oklahoma.

The material facts as shown by the record are, substantially, as follows:

On January 3, 1925,- Jack Liddell, petitioner, while employed by the Superior Smokeless Coal & Mining Company, according to his own testimony, received an injury while driving a mule in one of the mines of said company at Tahoma, Okla.; that the accident occurred about three o’clock in the afternoon on said date, as a result of mud and water which…
