This action is brought to review an award of the State Industrial Commission. On June 17, 1927, after a hearing, the Industrial Commission made an award in which it found that the claimant, John W. Lambert, was injured while in the employ of the Southern Fuel Company on October 4, 1923, and while engaged in a hazardous occupation, subject to the provisions of the Workmen’s Compensation Act, and that such injury arose out of and in the course of his employment, and that the claimant sustained an accidental injury which resulted in a permanent total disability; that the average wage…
