This case was transferred to the court after cross-motions for summary judgment had been briefed. Plaintiffs challenge a determination by the United States Department of Agriculture (the “USDA” or the “Department”) denying coverage to part of their 1977 sugar crop under a price support payment program for the 1977 crop of sugar beets and sugar cane administered by the Commodity Credit Corporation and the Agricultural Stabilization and Conservation Service.
