Five employees and former employees of the City of Indianapolis (“the City”) sued the City and Bart Peterson, Mayor of the City of Indianapolis, for overtime compensation pursuant to the Fair Labor Standards Act (“FLSA”), 29 U.S.C. § 207, et seq. Defendants filed a Motion for Summary Judgment and supporting documents arguing that Plaintiffs were exempt administrative and/or executive employees as defined by 29 U.S.C. § 213(a)(1).
