DECISION and ORDER

FELDMAN, United States Magistrate Judge.

Pursuant to 28 U.S.C. sections 636(b)(1)(A) and (B) the Honorable Michael A. Telesca *139referred this matter to the undersigned by an order dated May 15, 1996. Third-party witness, Michael R. Privitera, M.D., moves to quash a subpoena issued by Defendant, Teachers Insurance and Annuity Association (“TIAA”). In the alternative Dr. Privitera moves the Court to require TIAA to pay his costs and expenses in excess of the statutory fee.
