I. Introduction.

This is an action under the Federal Employers Liability Act (FELA), 45 U.S.C. §§ 51-60. Plaintiff Everett L. Starling claims that on July 2, 1997, in the course of his employment as a train conductor for defendant Union Pacific Railroad Company (Union Pacific), he was injured when the *471locomotive on which he was working collided with another train on a railroad siding west of Topeka, Kansas.
