BELOT, District Judge.

Plaintiff was terminated from his job with Unisys, at age fifty-two, as part of a reduction in forces (“RIF”) layoff. He filed this employment discrimination lawsuit against Unisys claiming that, in discharging him, Unisys violated the Age Discrimination and Employment Act (“ADEA”), 29 U.S.C. § 621 et seq., and section 510 of the Employee Retirement Income Security Act (“ERISA”), 29 U.S.C. § 1140. 1 (Complaint, Doc. 1, Counts I & IV).
