The accused, Gibson, was tried by general court-martial under a charge of unpremeditated murder, in violation of Article 118, Uniform Code of Military Justice, 50 USC § 712. The specifica*513tion alleged that he shot and killed one Kim Yaun Sil, a member of the military service of the Republic of Korea. At the commencement of the trial, he pleaded not guilty to the charge and specification, but guilty of the lesser included offense of voluntary manslaughter.
