MEMORANDUM OPINION

Plaintiff Public Employees for Environmental Responsibility (“PEER”) brings this lawsuit against defendant United States Department of Commerce, National Oceanic and Atmospheric Administration, National Marine Fisheries Service (“NMFS”), alleging that NMFS violated the Freedom of Information Act (“FOIA”), 5 U.S.C. § 552 (2006), by improperly denying PEER’S request for a fee waiver.
