This is an appeal by defendants City of Oakland (hereinafter referred to as "the City”) and Robert McCurdy from a judgment in favor of plaintiff in an action for damages for personal injuries and property damage arising out of a collision occurring on October 15, 1966, between the City’s police car, driven by McCurdy, and plaintiff’s automobile. The only issue presented to the trial court was whether plaintiff’s action was barred by the statute of limitations.
