In this action in trespass tbe plaintiff obtained tbe verdict of a jury against both defendants and the court below thereafter entered judgment n. o. v. for defendant, Paul Steiner, on the ground that John Marback, the other defendant, was an independent contractor and therefore was alone liable for the injuries inflicted upon the plaintiff. We are all of the opinion that judgment should not have been entered for Steiner.
