Plaintiff brought this action to recover damages alleged to have been suffered through breach of a contract by which plaintiff was appointed the exclusive jobber for the products of the defendant Chapman Valve Manufacturing Company (designated herein as “defend ant”), in the territory of southern California. The breach alleged consisted of the making of direct sales by said defendant in plaintiff’s territory in alleged violation of the agreement, by reason of which plaintiff was deprived of the profits it would have made had it handled the sales as jobber.
