Defendant, David L. Berry (Berry), appeals from a summary judgment entered in favor of the plaintiff, Steve Schmidt & Co. (Schmidt & Co.), for $57,750, representing a real estate commission, plus attorney’s fees and costs. Schmidt & Co., a licensed real estate broker, sued Berry, Darwin G.
