MEMORANDUM OPINION
KENNEDY, District Judge.
Mark Jasperson brings this action against the Federal Bureau of Prisons (“BOP”) and Harley G. Lappin, the Director of the Bureau, in his official capacity. His complaint includes two counts, one seeking a declaratory judgment and the other seeking relief under the mandamus statute. Jasperson, who was sentenced to a term of imprisonment of four months, seeks preliminary injunctive relief against BOP, and in particular to have his place of confinement determination reviewed for possible placement in a halfway house.
