OPINION
PAUL L. FRIEDMAN, District Judge.
This matter is before the Court on defendants’ Motion to Dismiss or, in the Alternative, for Summary Judgment. For the reasons stated below, the Court will dismiss this action.
I. BACKGROUND
At all times relevant to the Complaint, plaintiff was a prisoner at the Federal Correctional Institution in Waseca, Minnesota (“FCI Waseca”) serving a 27-month sentence for a violation of the terms of his supervised release.
