SMITPI, Chief Justice.

This is an appeal from an order of the district court granting a summary judgment of reversal of an Idaho county probate court order admitting to probate the alleged last will of William P. Killgore, who died March 15, 1956.

Appellant, decedent’s widow, in her petition for letters of administration filed in the probate court July 31, 1956, alleged “due search and inquiry” had failed to disclose a last will and testament of her deceased husband, and that he had died intestate.
