OPINION AND ORDER
FUSTE, District Judge.
This is another in a series of collection actions by the Federal Deposit Insurance Corporation (“FDIC”) concerning the assets of the failed bank, Girod Trust Company (“Girod”). Since the FDIC brings this action in its corporate capacity, federal jurisdiction is present. 12 U.S.C. sec. 1819 and 28 U.S.C. sec. 1345. The matter now stands submitted on plaintiffs unopposed motion for summary judgment. Docket Document No. 27. For the reasons that follow, we grant the motion and enter summary judgment in plaintiff’s favor.
