ORDER GRANTING IN PART AND DENYING IN PART DEFENDANT’S MOTION TO DISMISS

This matter came before the Court on Monday, September 17, 2007, on Defendant’s motion to dismiss the complaint. After carefully considering the parties’ written and oral arguments, the Court GRANTED IN PART and DENIED IN PART Defendant’s motion at the conclusion of the hearing.
