MEMORANDUM OF DECISION AND ORDER

Mary Lambertson (“Lambertson” or the “plaintiff’) initiated this action against Kerry Ingredients, Inc. (“Kerry” or the “defendant”) by filing a complaint in the Supreme Court of the State of New York, County of Nassau. The complaint, dated June 1, 1998, alleges that she was subjected to gender based discrimination and sexual harassment in violation of the New York State Human Rights Law, N.Y.
