Joseph Kern instituted his action in the Court of Common Pleas of Mahoning County against Contract Cartage Company praying damages for personal injuries alleged to have been received when the automobile driven by him upon Wick Avenue, one of the main streets of the city of Youngstown, ran into the left side of the equipment which that company had been using for the purpose of transporting automobiles and which the operator thereof was at the time engaged in backing into a parking lot on the east side of Wick Avenue.
