—In an action to recover damages, inter alia, for legal malpractice, the plaintiff appeals from an order of the Supreme Court, Suffolk County (Cohalan, J.), dated September 28, 1994, which granted the defendant’s motion to dismiss the complaint pursuant to CPLR 3211 (a) (5) upon the ground that it is barred by the Statute of Limitations.

Ordered that the order is modified, on the law, by deleting the provision thereof which granted that branch of the defendant’s motion which was to dismiss so much of the complaint as asserts a cause of action to recover damages for breach of a retainer…
