It appears from the record in this case, that upon an interlocutory hearing of a petition filed by Willis to enjoin Smith from working for turpentine purposes timber growing upon a certain tract of land to which the former asserted title, the judge granted a temporary injunction on condition that the plaintiff would within ten days file with the clerk of the court a bond in the sum of $1,000, to indemnify the defendant against any loss he might in consequence sus*793tain.
