This matter comes before the court on the summary judgment motion of defendant Farmland Industries, Inc. (hereinafter “Farmland”). The four plaintiffs allege various age discrimination and retaliation claims, pendent state law claims of breach of an implied employment contract and fraud, and a claim under the Employee Retirement Income Security Act, 29 U.S.C. §§ 1001 et seq.
