This proceeding originated in a claim which was presented by Dell Bennett as claimant against the estate of Henry B. Miller, deceased, which was being ad*311ministered in the probate court of Kalamazoo county. The claim was disallowed by the commissioners on claims, and the claimant appealed to the circuit court. A brief statement may aid in an understanding of the claim. In the year 1906 Henry B.
