The sole issue presented is whether Code of Civil Procedure section 337.15 1 operates to bar the cross-complaint for indemnity filed by the owners (appellants Majors, Hourigan and Harbor Towers, collectively Harbor Towers) against the builder and architect (respondents Kaehler-Farrar Development, Inc., Reuben Kaehler and D. H. Gregory Coleman, collectively Kaehler).

The complaint was filed on April 27, 1976, by Beulah Ann Grimmer, the mother and guardian ad litem of the one and one-half-year-old minor plaintiff, Ria Grimmer. The complaint alleged that on August 10, 1975,…
