Tomlinson Irving Moseley and Dorothy Barbara Moseley, owners of an apartment complex in the City of Corte Madera, appeal from an order of dismissal entered after the superior court sustained, without leave to amend, architect Ned H. Abrams’ demurrer to their “Third Amendment to Complaint” (hereinafter complaint) on the ground that the action— one based on breach of contract—was time-barred by the 10-year limitations period prescribed in Code of Civil Procedure section 337.15.
