This is an error proceeding seeking the reversal of a conviction of first degree murder without recommendation of mercy had in the court of common pleas of Belmont county, Ohio, which conviction was affirmed by the Court of Appeals. The first assignment of error is that the trial court erred in overruling a motion challenging the array of the petit jury. The cause was originally assigned for trial on November 20, 1922. The prosecuting attorney filed a precipe for a special venire on October 30, 1922, the same was served by the sheriff, and the return, showing manner of service, was indorsed…
