VALLÉE, J.

By information defendant was charged in count I with assault with a a deadly weapon upon his stepdaughter, Janice Dizon, and in count II with the same offense upon his wife, Doris Eedwine. On count I defendant was found not guilty. On count II he was convicted of assault. He appeals from the judgment.

The question is: Did the court abuse its discretion in denying defendant’s motion to be relieved of his waiver of a trial by jury and-thus deny him his constitutional right to a trial by jury ?
