CAMPBELL, J., pro tem.

Appellant was convicted of the crime of attempt to commit robbery, and from such judgment of conviction and an order of the trial court denying his motion for a new trial has appealed.

At about 1:40 or 1:50 o’clock on the morning of May 4, 1925, appellant was taken to the Mission Emergency Hos pital in San Francisco suffering from a gunshot wound in the abdomen.
