This is a trespass action for deceit and fraud. Tbe trial resulted in a non-suit after plaintiff persistently refused to accept tbe view of tbe learned court below on wbat constitutes tbe true measure of damages.
Tbe evidence was sufficient, if believed by tbe jury, to make out a case of deceit and fraud. Only proof as to damages stood between plaintiff and tbe jury. A few of tbe facts are necessary to understand tbe conflicting views of tbe parties.
