This writ of error was sued out by plaintiff in error to review a decree of the circuit court of McLean county granting the relief prayed in a bill filed by defendant in error to remove a cloud from and quiet title to real estate.

The facts out of which this litigation arises are as follows : The Illinois Savings and Trust Company held a first mortgage on the real estate described in the bill, dated October 2, 1911, to secure a note-for $6000, due five years after date, with an option to the mortgagee to declare the principal due for default in payment of interest.
