This consolidated interlocutory appeal concerns approximately 100 criminal and civil suspension cases in Rutland, Bennington and Washington Counties, brought against defendants for driving under the influence of alcohol (DUI). In all of these actions, the State seeks to introduce evidence of blood-alcohol content (BAC) from a Datamaster infrared testing device.
