The complaint is in the usual form; it alleges that the subject-matter of the action is 9% tons of oats of the value of $465 owned by the plaintiff October 6,1927, the day of the alleged conversion. The answer, after denying all allegations of the complaint, alleged by way of “a further and separate answer to said complaint” the matter which we shall now review.
