This is an appeal by A. Y. Overman, a third-party claimant in an attachment proceeding, from an order of the circuit court for Multnomah county, overruling his motion to compel the sheriff to pay to him the sum of $4,428.88, seized by the sheriff under a writ of attachment issued out of said court in an action then pending, wherein C. C. Francisco was plaintiff and J. L. Stringfield was defendant.
The statute under which these proceedings were instituted and the order appealed from was made provides as follows:
