Per Curiam :

This case comes before the court on requests for review, under Rules 166(e) and 54(b) (3), of a recommended decision filed May 30, 1972, by Trial Commissioner Mastín G. White pursuant to Rule 166(c) wherein he denied plaintiff’s motion for summary judgment and allowed defendant’s cross motion.

Since the court is in agreement with the opinion and recommendation of the Commissioner, with a modification thereof by the court, it hereby adopts the same, as modified, as the basis for its judgment in this case as hereinafter set •forth. Therefore, plaintiff is not entitled to recover and…
