This action was commenced in tfie district court of Ok-mulgee county, Okla., by R. E. Simpson, plaintiff in 'error, against J. Will Baker, defendant in error, to recover a one-third interest in the northwest quarter of section 23, township 13 north, range 13 east, in Okmul-gee county, Okla., consisting of 160 acres, due fiim under a written contract for an attorney’s lien and to enforce said lien.
