This is an appeal from the'Court of Common Pleas of Oklahoma County. The parties are referred to here as they appeared in the trial court.

E. F. Carney and Enola Carney, husband and wife, on August 1, 1950, entered into a written contract with the defendant, E. E. Fine'frock, for the purchase of a six room house then under construction by the defendant in Oklahoma City, Oklahoma.
