— Appeal from a judgment of the County Court of Rensselaer County (Clyne, J.), rendered December 29, 1981, upon a verdict convicting defendant of the crime of burglary in the second degree. Defendant was indicted for the crimes of burglary in the second degree and grand larceny in the second degree. After a trial, he was found guilty of burglary in the second degree, the only count submitted to the jury.
