— Appeal from a judgment of the County Court of Albany County (Clyne, J.), rendered February 19, 1982, upon a verdict convicting defendant of the crime of burglary in the third degree. In November, 1981, defendant was indicted for burglary in the third degree (Penal Law, § 140.20) stemming from an alleged entry into Izzy’s Pub in the City of Albany on October 19, 1981. Following a hearing, the court refused to suppress certain testimony regarding a show-up identification, as well as oral statements made by defendant.
