Motion to dismiss appeal from a certain order made by the court below.

The plaintiff sued the defendants, who are physicians and surgeons, for damages for injuries alleged to have been directly ■ produced by their negligence while they were engaged in the performance of a surgical operation upon his person. The cause was tried by a jury, and verdict and judgment in favor of the plaintiff followed. In due time defendants took an appeal from said judgment, and subsequently said appeal was heard and considered by this court, with the result that the judgment was reversed and the cause remanded to…
