Before the court are defendant’s “Motion to Dismiss or, in the Alternative, for Judgment Upon the Administrative Record, in part, and for Summary Judgment, in part” and plaintiffs motion for discovery pursuant to Rule 56(f) of the Rules of the United States Court of Federal Claims (“RCFC”).
