OPINION
WIESE, Judge.
Plaintiff, C.J. Betters Corporation, was the successful bidder in a solicitation issued by the Department of Housing and Urban Development (HUD) inviting offers to purchase, on an “as is” basis, a rent-subsidized apartment complex in Pasadena, Texas. As the present owner of the complex, Betters is suing here to recover contract damages based on alternative theories of entitlement.
